Terms of Service

1. Acceptance of Terms

By accessing or using the website jingweijiaye.com ("Website"), mobile applications ("Applications"), and services provided by Beijing Jingwei Jiaye Human Resources Co., Ltd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. By using our services, you represent that you are at least 13 years of age (or 16 in certain jurisdictions) and have the legal capacity to enter into this agreement.

  • Employment and entrepreneurship guidance services
  • Human resources management consulting services
  • Human resources service outsourcing
  • Business management consulting services
  • Market research services (excluding foreign-related surveys)
  • Enterprise image planning and marketing strategy services
  • Conference and exhibition organization services
  • Organizational cultural exchange activity services
  • Labor services (excluding labor dispatch services)
  • Mobile applications for workforce management

3. User Accounts

3.1 Account Registration

To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

We reserve the right to suspend, disable, or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Mobile Application Terms

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile applications on devices you own or control, solely for personal, non-commercial purposes.

4.2 App Store Distribution

Our mobile applications are distributed through:

  • Apple App Store: For iOS devices including iPhone, iPad, and iPod touch
  • Google Play Store: For Android devices

You acknowledge that these Terms are between you and us, not with Apple Inc., Google LLC, or their respective subsidiaries. Apple and Google are not responsible for our applications or their content.

4.3 App Updates

We may provide updates, upgrades, or modifications to our applications from time to time. You may need to update third-party applications if prompted. We do not guarantee that our applications will be compatible with all devices or operating system versions.

4.4 App Removal

You may uninstall our applications at any time. These Terms will continue to apply to your use of our services even after you remove the application from your device.

5. Advertising and Monetization

5.1 Ad Display

Our mobile applications may display advertisements from third-party ad networks ("Ad Partners"). These advertisements may be displayed in various formats including:

  • Splash Ads: Full-screen advertisements shown during app launch
  • Rewarded Video Ads: Video advertisements offering in-app rewards
  • Interstitial Ads: Full-screen advertisements at content transitions
  • Banner Ads: Rectangular advertisements within app content
  • Native Ads: Advertisements matching app design
  • Playable Ads: Interactive demonstration advertisements

5.2 Ad Partners

We work with multiple advertising partners including but not limited to: Google AdMob, Facebook Audience Network, Unity Ads, AppLovin MAX, ironSource, MoPub, AdColony, Vungle, Chartboost, Pangle, Mintegral, Liftoff, Appnext, Smaato, HyprMX, InMobi, Ogury, Start.io, azooZ, and Inneractive.

5.3 Ad Targeting

Advertisements may be targeted based on information collected by us and our Ad Partners, including device identifiers, location data, app usage patterns, and user demographics. You can control certain advertising preferences through your device settings.

6. User Conduct

You agree not to:

  • Violate any laws, regulations, or third-party rights
  • Use our services for any illegal or unauthorized purpose
  • Interfere with or disrupt our services or servers
  • Attempt to gain unauthorized access to our systems
  • Transmit any viruses, malware, or harmful code
  • Collect or harvest user data without consent
  • Impersonate any person or entity
  • Upload false, inaccurate, or misleading information
  • Reverse engineer, decompile, or disassemble our applications
  • Remove or modify any proprietary notices
  • Use automated systems or robots to access our services
  • circumvent any security measures or access restrictions

7. Intellectual Property

7.1 Our Content

All content, features, functionality, and materials provided through our services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the design and selection thereof, are the exclusive property of Beijing Jingwei Jiaye Human Resources Co., Ltd or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

7.2 Trademarks

Our trademarks, service marks, trade names, and trade dress may not be used in connection with any product or service without prior written consent. All other trademarks appearing on our services are the property of their respective owners.

7.3 User Content

You retain ownership of content you submit, post, or display on or through our services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing our services.

8. Service Availability

We strive to provide uninterrupted access to our services, but we do not guarantee continuous, uninterrupted, or secure access. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

9. Fees and Payments

9.1 Paid Services

Certain features or services may be available only through paid subscription or one-time purchase. All fees are displayed in the applicable currency and do not include applicable taxes unless stated otherwise.

9.2 Refunds

Unless otherwise required by law, all purchases are final and non-refundable. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

9.3 Fee Changes

We reserve the right to change fees for our services. Fee changes will be communicated through our website or application with reasonable notice before taking effect.

Our services may contain links to third-party websites, applications, or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) OUR SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS; (D) ANY INFORMATION OBTAINED FROM OUR SERVICES WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) our services
  • Any conduct or content of any third party on our services
  • Any content obtained from our services
  • Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless Beijing Jingwei Jiaye Human Resources Co., Ltd, its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of our services.

14. Age Restrictions

14.1 Minimum Age

You must be at least 13 years old to use our services (or 16 years old for users in the European Economic Area, United Kingdom, or other specified jurisdictions). If you are under 18, you represent that you have obtained parental or guardian consent to use our services.

14.2 Children's Services

Our services are not directed to children under 13 (or 16 in certain jurisdictions). We do not knowingly collect personal information from children under the applicable minimum age without verifiable parental consent. If we become aware of such collection, we will take steps to delete the information promptly.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. For users in the European Union, this shall not affect any mandatory consumer protection rights you may have under the law of your country of residence.

16.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC) or other agreed arbitration institution.

16.3 Class Action Waiver

YOU AGREE THAT ANY CLAIM SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Beijing Jingwei Jiaye Human Resources Co., Ltd regarding your use of our services and supersede all prior agreements and understandings.
